QUICK SUMMARY: By using Ink To Tee, you agree that you own the rights to the images you upload. You agree to hold us harmless if any legal issues arise from your designs. We print what you upload "as-is."
1. Terms of Use
Welcome to Ink To Tee ("Company", "we", "our", "us"). These Terms of Service ("Terms") govern your use of our website and services. By accessing or using the Service, you agree to be bound by these Terms. If you disagree with any part of the terms, you may not use the Service.
1.1 Account Responsibilities
You are responsible for safeguarding the password that you use to access the Service. You agree not to disclose your password to any third party. You must notify us immediately upon becoming aware of any breach of security or unauthorized use of your account.
1.2 Right to Refuse Service
We reserve the right to refuse service to anyone for any reason at any time. We may, in our sole discretion, limit or cancel quantities purchased per person, per household, or per order.
2. User Content & Intellectual Property
Our service allows you to upload, submit, store, and send digital content ("User Content"). You retain ownership of any intellectual property rights that you hold in that User Content.
PROHIBITED CONTENT POLICY
You agree NOT to upload content that includes:
- Child sexual abuse material (CSAM) or any sexually explicit content.
- Hate speech promoting violence against individuals or groups based on race, religion, gender, or orientation.
- Material that violates the intellectual property rights of others (e.g., trademarks you do not own).
2.1 Passive Conduit
You acknowledge that Ink To Tee is an automated printing service and acts merely as a passive conduit for the production of User Content. We do not manually review all submissions for legal compliance.
2.2 DMCA Copyright Notice
If you believe your copyright has been infringed by content on our platform, please send a notice to legal@inktotee.com containing:
- Physical or electronic signature of the copyright owner.
- Description of the copyrighted work and where it is located on our site.
- Your contact information.
3. Indemnification
THIS IS A BINDING LEGAL AGREEMENT. READ CAREFULLY.
You agree to indemnify, defend, and hold harmless Ink To Tee, its parent companies, subsidiaries, affiliates, partners, officers, directors, agents, contractors, licensors, service providers, subcontractors, suppliers, interns, and employees, harmless from any claim or demand, including reasonable attorneys’ fees, made by any third party due to or arising out of your breach of these Terms of Service or the documents they incorporate by reference, or your violation of any law or the rights of a third-party.
Specific Example: If you upload a logo owned by a major sports league or corporation without a license, and that entity sues Ink To Tee for printing it, YOU are financially responsible for our legal defense and any damages awarded.
4. Shipping, Refunds & Cancellations
4.1 Custom Goods Policy
Due to the custom nature of our products (Gang Sheets and Custom Apparel), ALL SALES ARE FINAL. We do not offer returns or refunds for buyer's remorse, wrong sizes ordered, or low-resolution artwork provided by the user.
4.2 Force Majeure
Ink To Tee shall not be liable for any delay or failure to perform resulting from causes outside its reasonable control, including, but not limited to, acts of God, war, terrorism, riots, embargos, acts of civil or military authorities, fire, floods, accidents, strikes, or shortages of transportation facilities, fuel, energy, labor, or materials.
5. Print & Color Disclaimers
By placing an order, you acknowledge the limitations of digital printing (DTF) technology:
- RGB vs CMYK: Your screen displays color in RGB (light). We print in CMYK + White (ink). Some bright neons on your screen may appear slightly less vibrant when printed. This is a physical limitation of ink.
- Color Variance: We do not guarantee 100% Pantone matching. Minor color shifts may occur between reprints.
- Artwork Quality: We print exactly what you upload. If you upload a blurry 72 DPI image, you will receive a blurry print. We recommend 300 DPI for all uploads.
6. Privacy Policy
We respect your privacy. This section outlines how we handle your data.
- Data Collection: We collect your name, email, shipping address, and uploaded image files solely for the purpose of fulfilling your order.
- Third Parties: We share necessary data with our payment processors (e.g., Stripe) and shipping carriers (e.g., USPS/UPS). We do not sell your data to advertisers.
- Security: We use industry-standard encryption (SSL) to protect your information during transmission.
7. Dispute Resolution & Governing Law
7.1 Governing Law
These Terms shall be governed and construed in accordance with the laws of the Commonwealth of Kentucky, United States, without regard to its conflict of law provisions.
7.2 Arbitration & Class Action Waiver
Any dispute arising from or relating to the subject matter of this Agreement shall be finally settled by arbitration in Jefferson County, Kentucky. You agree that you may only resolve disputes with us on an individual basis, and may not bring a claim as a plaintiff or a class member in a class, consolidated, or representative action.
7.3 Statute of Limitations
You agree that regardless of any statute or law to the contrary, any claim or cause of action arising out of or related to use of the Service must be filed within one (1) year after such claim or cause of action arose or be forever barred.
